Terms of Use

The agreement between Aura Systems Ltd. and the people who use HushFun.com, covering eligibility, accounts, acceptable use, the content you share, and your rights.

1. Introduction — Agreement to these Terms

These Terms of Use (the "Terms") set out the agreement between you and us for your use of the HushFun.com website and app.

Aura Systems Ltd. ("Aura Systems", "we", "us" or "our") is the company that provides HushFun.com. We are based in the United Kingdom and we operate HushFun.com, a profile-based social and community application focused on adult kink and relationship education and community.

By accessing or using our Website or our App, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not access or use the Service.

These Terms form a legally binding agreement between you and Aura Systems. They apply to:

  • the HushFun.com marketing website, where these Terms are published and where you can read about HushFun.com and browse educational content; and
  • the HushFun.com app, which you register for and log in to in order to create a profile and take part in the community.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information. By using the Service, you also acknowledge our Privacy Policy. Please read both documents carefully.

Because HushFun.com is an adult platform, please pay particular attention to Section 3 (Eligibility & age requirement), Section 5 (Acceptable use) and Section 6 (User-generated content).

2. Definitions

In these Terms, the following words have the following meanings:

  • "Account" — the registered account you create to access and use the App.
  • "App" — the HushFun.com profile-based social and community application, including all of its features, software and functionality.
  • "Content" — any text, images, video, audio, data or other material made available through the Service, whether by us or by users.
  • "Service" — the Website and the App together, including all related features, tools and content we provide.
  • "Terms" — these Terms of Use, as updated from time to time.
  • "User", "you" or "your" — any person who accesses or uses the Service, whether or not registered.
  • "User-Generated Content" (or "UGC") — any Content that you or other users create, upload, post, share or otherwise make available through the Service, including images, videos and audio recordings.
  • "Website" — the HushFun.com marketing website on which these Terms are published.
  • "we", "us", "our" — Aura Systems Ltd.

3. Eligibility & age requirement (18+)

HushFun.com is an adult platform and is strictly for people aged 18 or over.

By accessing or using the Service, you represent and warrant that:

  • you are at least 18 years of age (or the age of majority in your place of residence, if that is higher);
  • you have the legal capacity to enter into a binding contract with us; and
  • you are not barred from using the Service under the laws of any applicable jurisdiction.

Age verification. Because HushFun.com is an adult platform, we require age verification before you can use the App. You agree to provide accurate information for this purpose and acknowledge that we may use third-party age and identity verification providers as described in our Privacy Policy.

Consequences of misrepresentation. If you misrepresent your age, or if we reasonably believe that you are under 18, we may immediately suspend or terminate your Account and remove your Content. Providing false information to gain access to an adult platform is a serious breach of these Terms and may also be unlawful.

The Service is not intended for, and must not be used by, anyone under the age of 18. If you are not yet 18, you must not access the App or attempt to register.

4. Accounts & registration

To use the App, you must register for an Account. When you do, you agree to the following.

4.1 Accurate information

You must provide accurate, current and complete information when you register, and keep your Account information up to date. You must not register using a false identity or impersonate anyone else.

4.2 Account security

You are responsible for keeping your login credentials confidential and for all activity that takes place under your Account. We recommend that you:

  • choose a strong, unique password and do not reuse it on other services;
  • enable any additional security features we offer, such as multi-factor authentication; and
  • never share your credentials with anyone else.

4.3 One person per account

Your Account is personal to you. Unless we agree otherwise in writing, each Account is for the use of one individual person, and you must not share, sell, transfer or licence your Account to anyone else.

4.4 Unauthorised use

You must notify us promptly at support@hushfun.com if you become aware of, or reasonably suspect, any unauthorised access to or use of your Account, or any other breach of security. We are not liable for any loss arising from unauthorised use of your Account where you have failed to keep your credentials secure.

5. Acceptable Use Policy / Prohibited conduct

HushFun.com is built on consent, respect and safety. To keep our community safe, you agree that you will not do any of the following, and will not use the Service to:

5.1 Zero tolerance — minors and child sexual abuse material

  • post, share, request, solicit or facilitate any content that sexually exploits or endangers a minor, including child sexual abuse material (CSAM), or any content depicting, describing or involving anyone under 18 in a sexual context. We operate a strict zero-tolerance policy. We will remove such content, terminate the Account, preserve relevant information, and report to law enforcement and the relevant authorities as required by law.
  • allow, encourage or assist any person under 18 to access or use the Service.

5.2 Non-consensual and unlawful content

  • upload or share non-consensual content, including intimate images or recordings of any person shared without their consent (sometimes called "revenge porn" or image-based abuse);
  • post content depicting anyone who has not given their informed, voluntary consent to be depicted in that way;
  • post any content that is unlawful, or that promotes, facilitates or instructs others in unlawful activity.

5.3 Harassment, abuse and hate

  • harass, bully, threaten, stalk or intimidate any person;
  • post content that incites or promotes hatred, violence or discrimination against people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or any other protected characteristic;
  • engage in any conduct that is abusive, degrading or harmful towards others, beyond what is consensually agreed within lawful adult interactions.

5.4 Privacy, identity and safety of others

  • dox or publish any person's private or identifying information (such as their real name, address, workplace, contact details or other private data) without their consent;
  • impersonate any person or organisation, or misrepresent your affiliation with anyone;
  • attempt to identify, derive or reveal another user's exact location, or attempt to circumvent, defeat or reverse-engineer our "fuzzy proximity" location protections;
  • share another person's intimate or sexual images without their explicit consent.

5.5 Platform integrity and security

  • send spam, chain messages, pyramid schemes, scams or other unsolicited or fraudulent communications;
  • introduce or distribute viruses, malware, or any other harmful or disruptive code;
  • scrape, crawl, harvest or use automated means to access, collect data from, or interact with the Service without our prior written permission;
  • probe, scan or test the vulnerability of our systems, or breach or circumvent any security or authentication measures;
  • interfere with, disrupt or place an unreasonable load on the Service or its infrastructure;
  • copy, modify, reverse-engineer, decompile or create derivative works from any part of the Service except where permitted by law.

We may update this Acceptable Use Policy from time to time as our community grows and as new risks emerge. Breaching this section is a serious breach of these Terms and may result in immediate enforcement action under Section 7.

6. User-Generated Content

HushFun.com is a profile-based community platform, so much of what makes it valuable is the content that users create and share, including images, videos and audio recordings.

6.1 You keep ownership of your content

You retain ownership of the User-Generated Content you create and upload. These Terms do not transfer ownership of your Content to us.

6.2 The licence you grant us

To operate the Service, we need your permission to handle your Content. By uploading or sharing User-Generated Content, you grant Aura Systems a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, adapt (for technical purposes such as formatting and creating previews/thumbnails), transmit and display that Content solely to the extent necessary to operate, provide, secure and improve the Service and to make your Content available to others as you intend.

This licence exists only so that we can run the Service. It ends when you delete your Content or close your Account, except that we may retain copies for a limited period for backup, legal and safety purposes as described in our Privacy Policy.

6.3 Your warranties about your content

Each time you upload or share User-Generated Content, you represent and warrant that:

  • you own or have all the necessary rights, licences and permissions to share that Content and to grant the licence in Section 6.2;
  • the Content depicts only consenting adults aged 18 or over, and you have the consent of every identifiable person shown in it;
  • the Content is lawful and does not breach these Terms, our Acceptable Use Policy, or the rights of any third party (including privacy, publicity and intellectual property rights); and
  • sharing the Content does not breach any law or regulation that applies to you.

6.4 Your responsibility

You are solely responsible for the User-Generated Content you create, upload and share, and for the consequences of doing so. We do not endorse any User-Generated Content, and views expressed by users are their own. Please think carefully before uploading any sensitive or intimate media.

6.5 We may remove content

We are not obliged to monitor or pre-screen User-Generated Content, but we may review, refuse, restrict, remove or disable access to any Content at our discretion, for example where we reasonably believe it breaches these Terms or the law, or where removal is necessary to protect users or the community. See Section 7.

7. Content moderation & enforcement

To keep HushFun.com safe, we operate moderation and enforcement processes.

  • Review and moderation. We may review, moderate, remove or restrict Content, and we may use a combination of human review and automated tools to do so.
  • Reporting. If you see Content or behaviour that breaches these Terms, please report it using the in-app reporting tools or by contacting us. We take reports seriously and will act on them where appropriate.
  • Enforcement action. Where we find a breach, we may take action that is proportionate to the seriousness of the breach, including issuing a warning, removing Content, limiting features, or suspending or terminating your Account.
  • Discretion. Many moderation and enforcement decisions necessarily involve judgement, and we may make them at our reasonable discretion. Where the law gives you a right to challenge a decision or to be told the reason for it, we will honour that right.
  • Serious and unlawful conduct. For serious matters — in particular anything involving minors, non-consensual content or threats to safety — we may act immediately, preserve relevant information, and cooperate with law enforcement and the relevant authorities.

HushFun.com exists to support a respectful adult community around kink and relationship education. Consent comes before anything else on HushFun.com, and we hold every member to that.

By using the Service, you agree to uphold our community standards:

  • Consent first. Engage with others only on the basis of clear, informed and freely given consent. Respect boundaries, and recognise that consent can be withdrawn at any time.
  • Respect and dignity. Treat other members with respect. People will disagree, and that is fine, but abuse, coercion and harassment have no place here.
  • Privacy of others. Do not share another member's identity, private information or intimate content without their explicit consent.
  • Safety tools. We provide tools to help you stay safe — such as reporting, blocking and our "fuzzy proximity" location protection, which never reveals anyone's exact location. We encourage you to use them, and to make use of the safety resources we publish on our safety hub.

These standards are part of these Terms. Conduct that undermines consent, respect or safety may lead to enforcement action under Section 7.

9. Intellectual property (our rights)

Other than User-Generated Content, the Service and everything in it is owned by or licensed to Aura Systems.

  • Our IP. We (and our licensors) own all intellectual property rights in the Service, including the App and Website software, design, layout, graphics, text, the HushFun.com name and branding, logos and other materials we provide (excluding User-Generated Content).
  • Your limited licence. We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to access and use the Service for your own personal, non-commercial use, in accordance with these Terms. This licence does not allow you to copy, resell, redistribute or commercially exploit any part of the Service.
  • Trademarks. "HushFun.com", the HushFun.com logo and our other brand features are trademarks of Aura Systems Ltd. You must not use them without our prior written permission.

All rights not expressly granted to you in these Terms are reserved by Aura Systems and its licensors.

10. Privacy

Your privacy matters to us. How we collect, use, share and protect your personal information is set out in our Privacy Policy, which forms part of your agreement with us.

Among other things, our Privacy Policy explains our privacy-first approach to analytics on the Website, our "fuzzy proximity" location approach in the App, how we handle the media you upload, and your rights over your data. By using the Service, you acknowledge that your information will be handled as described in the Privacy Policy. For privacy questions or requests, contact privacy@hushfun.com.

The Service may contain links to, or integrate with, third-party websites, services or resources that we do not own or control.

We provide these links and integrations for convenience only. We are not responsible for the content, products, services, or privacy and security practices of any third party, and we do not endorse them. Your use of any third-party website or service is at your own risk and subject to that third party's own terms and policies. We encourage you to review them before you use such services.

12. Fees, payments & subscriptions

Some features of the Service may be free, while others may require payment or a paid subscription.

  • Free and paid features. We may offer some functionality at no charge and other functionality on a paid basis. We may change which features are free or paid over time.
  • Billing and renewal. Where paid features or subscriptions apply, you agree to pay all applicable fees. Subscriptions may renew automatically for successive periods unless cancelled before the renewal date, and we will make the billing cycle and price clear before you purchase. If you purchased a subscription, that subscription will automatically be billed via the payment method you provided at the billing interval chosen. Billing will take place on the same day of the month you initiated the subscription.
  • Payment processing. Payments may be handled by third-party payment processors, and your use of their services may be subject to their terms. Payments to be processed by Stripe
  • Taxes. Prices may be exclusive of applicable taxes, which you are responsible for where required.
  • Refunds and cancellation. Your statutory rights as a consumer are not affected by these Terms. Statutory cooling-off rights under the UK Consumer Contracts Regulations and any additional refund terms we choose to offer. Hushfun reserves the right to provide refunds on a pro-rata basis at its sole discretion.

If paid features are introduced or changed, we will update this section and, where required, give you notice and obtain any necessary consent before charging you.

13. Termination & suspension

13.1 Termination by you

You may stop using the Service and close your Account at any time through the App's settings or by contacting us. Closing your Account will end your licence to use the Service, and your Content will be handled as described in our Privacy Policy.

13.2 Suspension or termination by us

We may suspend or terminate your Account or your access to the Service, in whole or in part, where:

  • you breach these Terms, our Acceptable Use Policy or our community standards;
  • we are required to do so by law, or to protect the safety of users or the public;
  • you misuse the Service, or your conduct exposes us or others to legal or reputational risk; or
  • we reasonably consider it necessary to protect the integrity or security of the Service.

Where it is reasonable and lawful to do so, we will give you notice. For serious breaches — particularly those involving minors, non-consensual content or threats to safety — we may act immediately and without prior notice.

13.3 Effect of termination

On termination or closure of your Account:

  • your right to access and use the Service ends immediately;
  • your Content may be removed from the Service, subject to our retention and backup practices and any legal obligation to retain certain records (see the Privacy Policy); and
  • any provisions of these Terms that by their nature should survive termination — including Sections 6.2–6.4 (content licence and warranties), 9 (intellectual property), 14 (disclaimers), 15 (limitation of liability), 16 (indemnification), 18 (governing law) and 20 (general) — will continue to apply.

14. Disclaimers — "as is" and "as available"

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we make no warranties, representations or guarantees, whether express or implied, that:

  • the Service will be uninterrupted, timely, secure or error-free;
  • any defects will be corrected; or
  • the Service, or any Content available through it, will meet your requirements or expectations.

Interactions with other users are at your own risk. HushFun.com is a community platform, and we do not control how users behave or what they share. We do not vet users beyond age verification and our moderation processes, and we are not responsible for the conduct of any user, whether online or offline. Please use good judgement, use our safety tools, and take sensible precautions when communicating or meeting with other users.

Nothing in this section limits any warranty or right that cannot be excluded under applicable law, including your statutory rights as a consumer.

15. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, we do not exclude or limit our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot be excluded or limited under the laws of England and Wales.

Subject to the paragraph above, and to the fullest extent permitted by law:

  • we will not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profits, revenue, data, goodwill or anticipated savings, however arising;
  • we will not be liable for any loss or damage arising from the conduct of other users, from User-Generated Content, or from your reliance on the Service; and
  • our total aggregate liability to you arising out of or in connection with the Service and these Terms, whether in contract, tort (including negligence) or otherwise, will be limited to the greater of (a) the total amount you paid us for the Service in the 12 months before the event giving rise to the liability, or (b) £100.

If you are a consumer, this section does not affect your statutory rights that cannot be waived.

16. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Aura Systems Ltd. and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and reasonable expenses (including legal fees) arising out of or connected with:

  • your misuse of the Service;
  • your breach of these Terms, our Acceptable Use Policy or our community standards;
  • your User-Generated Content, including any claim that it infringes a third party's rights or breaches any law; or
  • your violation of any applicable law or the rights of any third party.

We may, at our option, take sole control of the defence of any matter for which you are required to indemnify us, and you agree to cooperate with us in doing so. This section does not apply to the extent a claim arises from our own breach or negligence, or where you are acting as a consumer and applicable law limits such indemnities.

17. Changes to the Service & to these Terms

  • Changes to the Service. We are continually improving HushFun.com, so we may add, change, suspend or remove features of the Service from time to time. Where a change materially reduces the Service, we will give you reasonable notice where we can.
  • Changes to these Terms. We may update these Terms from time to time, for example to reflect changes to the Service, to our practices, or to legal requirements. When we make material changes, we will update the "Last updated" date at the top of these Terms and, where appropriate, provide a more prominent notice (for example within the App or by email).
  • Your acceptance. Your continued use of the Service after updated Terms take effect means you accept the updated Terms. If you do not agree to the changes, you must stop using the Service and may close your Account.

18. Governing law & jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales will have jurisdiction to settle any such dispute or claim.

Your local consumer rights. If you are a consumer resident outside England and Wales, you may benefit from additional mandatory protections under the law of your country of residence that cannot be waived by agreement. Nothing in these Terms affects those non-waivable rights, and you may also be entitled to bring proceedings in your local courts where the law gives you that right.

19. Dispute resolution & complaints

Most concerns can be sorted out quickly when you raise them with us early. This section explains how to raise a complaint or dispute and the options available to resolve it.

19.1 Informal resolution first

If you have a complaint or a dispute, please contact us first so we can try to put things right. Email us at support@hushfun.com, setting out the issue and what you would like us to do. The vast majority of issues can be resolved this way, and we aim to acknowledge and respond to complaints within a reasonable timeframe. We will work with you in good faith to resolve the matter informally and promptly.

19.2 Alternative Dispute Resolution (ADR)

Alternative Dispute Resolution (ADR) is a process where an independent body considers the facts of a dispute and seeks to help the parties reach a resolution without going to court.

We are a UK-based business and we are not currently obliged to use, and are not registered with, any particular ADR scheme or provider. That said, if a dispute cannot be resolved informally, we will always consider in good faith any reasonable proposal to use ADR to help resolve it.

19.3 Online Dispute Resolution (ODR)

You may previously have seen references to the European Commission's Online Dispute Resolution (ODR) platform. Please note that the EU ODR platform was shut down on 20 July 2025 and is no longer operational, so it is not available to resolve any dispute with us. To raise a complaint, please use the informal route in Section 19.1 above.

19.4 Governing law and the courts

If a dispute cannot be resolved informally within a reasonable time, either of us may pursue the matter through the courts. As set out in Section 18 (Governing law & jurisdiction), these Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction to settle them. If you are a consumer, this does not deprive you of the protection of any mandatory statutory consumer rights that apply in your country of residence and that cannot be waived by agreement, and you may also be entitled to bring proceedings in your local courts where the law gives you that right.

19.5 Users outside the United Kingdom

As the Service becomes available in other countries in the future (for example the United States, Canada and other jurisdictions), additional or different dispute-resolution terms may apply to users in those regions. If that applies to you, you should refer to any region-specific terms provided to you, which will govern to the extent they differ from this section.

20. Miscellaneous / general

  • Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
  • Entire agreement. These Terms, together with the Privacy Policy and any additional terms that apply to specific features, make up the entire agreement between you and us regarding the Service, and supersede any prior agreements on that subject.
  • No waiver. If we do not enforce a right or provision of these Terms, that is not a waiver of that right or provision, and it does not prevent us from enforcing it later.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer ours to an affiliate or successor (for example as part of a business transfer), provided your rights are not adversely affected.
  • Force majeure. We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including network failures, outages of third-party services, acts of God, or government action.
  • No agency. Nothing in these Terms creates any partnership, agency or employment relationship between you and us.
